CITES & EXPORT NOTICE
CITES Documentation
Nepenthes are subject to international wildlife trade regulations under CITES and the applicable EU wildlife trade legislation.
For shipments outside the European Union, the required CITES export or re-export documentation will be provided by Nepenthesgrower where legally required.
Where required by the destination country, shipments may also require a phytosanitary certificate or other official export documentation.
The exact documentation required may vary depending on the species, destination country and applicable regulations.
Import Responsibility
International customers are responsible for checking the import requirements applicable in their country before placing an order.
This includes, where applicable:
- Obtaining any required CITES import permits or other import authorisations
- Ensuring compliance with national plant health and quarantine regulations
- Ensuring that the ordered species may legally be imported and possessed in the destination country
- Providing any information or documentation required for the preparation of export documents
- Paying applicable customs duties, import taxes, inspection charges, permit fees or other charges imposed by authorities in the destination country
Customers are strongly advised to contact their national CITES management authority, plant health authority and/or customs authority before ordering if they are unsure about the applicable requirements.
CITES Import Permits
Where the destination country requires a CITES import permit, the customer is responsible for obtaining the permit and providing a valid copy to Nepenthesgrower before shipment.
An order requiring such documentation may be held until all necessary permits and information have been provided.
Nepenthesgrower reserves the right to postpone or cancel an export shipment where the legally required documentation cannot be obtained or where shipment would otherwise violate applicable law.
Phytosanitary Requirements
Certain destination countries require live plants, seeds or other plant material to be accompanied by a phytosanitary certificate or to meet additional import conditions.
Where required, the relevant phytosanitary documentation will be arranged before export. Customers remain responsible for verifying whether their country imposes additional import permits, treatments, declarations, inspections or other requirements.
Customs Delays & Inspections
International plant shipments may be inspected by customs, CITES authorities, plant health authorities or other competent authorities.
Such inspections may result in additional processing time. Delivery estimates for international shipments therefore cannot guarantee the time required for customs clearance or official inspections.
Refused, Returned or Confiscated Shipments
If a shipment is refused, returned, destroyed or confiscated by authorities because the customer failed to obtain a legally required import permit, provided incorrect or incomplete import information, or ordered plants that cannot legally be imported into the destination country, any refund or replacement will be assessed in accordance with applicable law and the circumstances of the individual case.
Additional costs resulting from return shipping, storage, customs procedures, inspections or official charges may be borne by the customer where legally permissible.
This does not affect any mandatory statutory rights of consumers.
Changes in Import Regulations
CITES, customs and plant health regulations may change without notice. Import requirements may also differ between countries and, in some cases, between regions within the same country.
Customers should therefore verify the current requirements with the competent authorities before placing an international order.
Processing Time for Export Orders
Orders requiring CITES permits, phytosanitary certificates or other official export documentation may require additional processing time before shipment.
Documents must be issued or approved by the relevant authorities before the plants can legally be dispatched. Customers should take this additional processing time into account when placing an international order.
Legal Compliance
Nepenthesgrower will not knowingly ship plants where doing so would violate applicable CITES, EU, export or plant health regulations.
If legal shipment to the destination cannot be arranged, Nepenthesgrower reserves the right to refuse or cancel the shipment in accordance with applicable law.
